NOTTING HILL PUBLISHING LIMITED
LIMITED LICENCE AND LIMITED WARRANTY
1. You accept that these Terms and Conditions comprise the complete and sole legal relationship between you and Notting Hill. Notting Hill hereby grants you a non-exclusive personal licence to download, run, display and store Cybertation on a single designated computer on a single screen. You may make one copy solely for backup or archival purposes only. All rights not expressly granted to you under this Agreement are expressly reserved to Notting Hill.
2. Except as expressly authorised herein you may not reproduce, redistribute, retransmit, publish or otherwise transfer or commercially exploit, rent, lease, sub-licence, use for public performance, load, copy, modify, adapt, merge or otherwise exploit Cybertation or any part of it nor permit any third party not expressly authorised under this agreement to do so. You may not decompile, disassemble or reverse engineer Cybertation except to the extent allowed by the applicable law.
3. Notting Hill warrants that Cybertation will perform substantially in accordance with the instructions. Notting Hill makes no warranties or representations either express or implied in relation to Cybertation including but not limited to implied warranties of completeness, accuracy, merchantable quality and fitness for a particular purpose. You accept that Cybertation is provided on an "AS IS" basis.
4. Except for death and personal injuries arising from the negligence of Notting Hill or its employees, Notting Hill shall not be liable for any loss or damages whatever arising from or in any way connected with the supply, failure to supply, use or inability to use Cybertation either in contract, tort, negligence or under any statutory duty or otherwise including, but without limitation to damages for loss of profits, business interruption, loss of information or any other pecuniary or special damage or loss even when Notting Hill has been advised of the possibility of such loss or damage. Notting Hill's entire liability and your exclusive remedy shall be a refund of the purchase price paid for Cybertation.
5. This Agreement is effective until terminated. You may terminate this Agrement at any time by deleting Cybertation from your hard drive and destroying any copy. This Agreement will terminate immediately without notice from Notting Hill if you fail to comply with any provision of this Agreement. Upon termination you agree to delete Cybertation from your hard drive and destroy all copies in any form in your possession, whether or not that copy is authorised.
6. This Agreement is personal to you and you may not assign, sub-licence or alienate your rights hereunder in any whatsoever without prior written consent from Notting Hill. Your keyword is personal to you. It is your responsibility to keep the keyword secret and secure. You are responsible for the use or misuse of Cybertation by any person accessing Cybertation through use of your keyword (whether or not use is authorised or unathorised).
7. Cybertation and all data, software and other materials contained in it and all intellectual property therein are the property of Notting Hill and are protected by law.
8. If any provision of this Licence is held by a court of competent jursidiction to be contrary to law, the remaining provisions of this Agreement will remain in full force and effect.
9. To the extent permissible by local law this Agreement shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English Courts. This Agreement shall not affect your statutory rights.
